Rule For Land Rights

Bhubaneswar: The State Government has notified a new Draft Rule to provide land rights to the slum dwellers under Jaga Mission so that they can avail housing loan to construct houses.  

Additional Chief Secretary (ACS), Revenue & Disaster Management, Satyabrata Sahu has notified the draft Odisha Survey and Settlement (Amendment) Rules, 2023 on 3 November.

“All persons likely to be affected thereby and notice is hereby given that the said draft will be taken into consideration on or after the expiry of thirty days from the date of publication of this notification in the Odisha Gazette,” Shri Sahu said.

Any objection or suggestion which will be received from any person with respect to the said draft before expiry of the period so specified will be considered by the State Government, the ACS said.

The draft rule was issued for settlement of land and certificate of land right to a slum dweller in accordance with the provisions of the Odisha Land Rights to Slum Dwellers Act, 2017 and the Odisha Municipal Corporation (Amendment) Act, 2022.

As per the draft, the land so recorded/ mutated shall not be deducted from the Government Khata and the new Khata so prepared shall not be assessed to rent and cess.

A new Bata Khata /plot will be created under the nomenclature of “Certificate of Land Rights (CLR)” Khata and recorded without changing the kisam of the land.

Sattwa of the new Bata Khata/ plot will be recorded as Certificate of Land Right (SLR) issued in accordance with the provisions of the Odisha Land Rights to Slum Dwellers Act, 2017 and the Odisha Municipal Corporation (Amendment) Act, 2022.

“The land shall be heritable but not transferable by sublease, sale, gift or any other manner whatsoever except by way of mortgage for the purpose of raising finance in the form of housing loan from any financial institution,” it said.

The State Government reserves the right to issue appropriate executive instruction from time to time for correction of record of right on the basis of Certificate of Land Rights Certificate.

In August 2023, Chief Minister Naveen Patnaik had distributed land rights certificates to 65,000 families from 875 slums in the State under the Government’s flagship Jaga Mission.

In the first phase, the certificates were handed over to the slum dwellers of Bhubaneswar, Cuttack, Berhampur, Rourkela and Sambalpur municipal corporations.
