State Government has brought in a new statute, which will govern land allotment in Capital Region.
Thanks to overdrive of Chief Secretary Asit Tripathy the hurdle in such action has been eliminated due to inclusion of the statute.
As per the Government of Odisha Rules of Business, general control over new Capital and government land lying within the BMC area and leasing and transferring of sites in New Capital is the subject matter of GA & PG Department.
Accordingly, GA &PG Department was allotting government land within BMC area for different purposes under the provisions of the Government Grants Act, 1895.
Now, the said Government Grants Act, 1895 has been repealed by Parliament vide the Repealing and Amending (Second) Act, 2017.
As the Government Grants Act 1895 has been repealed, GA&PG Department has proposed for amendment of the Odisha Government Land Settlement Rules (OGLS), Rules 1983 by inserting a separate Schedule for allotment of lands within the Bhubaneswar municipal Corporation Area limits.
Accordingly a new Rule No.5AA has been inserted in the Odisha Government Land Settlement Rules, 1983 providing that the lands within the limits of the Bhubaneswar Municipal Area shall be governed as per the procedure laid down in Schedule-IV-A and a new Schedule No. IV-A has been added to the OGLS Rules enumerating the procedure for such allotment.
Preliminary notification for the draft OGLS (Amendment) Rules, 2020 was published in an extraordinary issue of the Odisha Gazette No. 948, dated the 6th July, 2020 under the notification of the Government of Odisha in the Revenue and Disaster Management Department No. RDM-LRGEA-STATUT-AAOI-2O2O- 21427 /R&DM., dated the 3rd July, 202O inviting objections and suggestions- from all persons likely to be affected thereby till the expiry of a period of thirty days from the date of publication of the said notification in the Odisha Gazette.
The final notification of the Rules published today i.e on 8 September, 2020.
