ESMA In Coal Mines

Odisha Government has extended Odisha Essential Services (Maintenance) Act-1988 (ESMA) prohibiting strikes in Mahanadi Coalfields Limited (MCL) Talcher Areas, which experiences frequent strikes.

ESMA was clamped on 15 May, 2019 to prohibit strikes in MCL’s Talcher Coalfields Areas, which has been extended for another Six Months keeping in view the emerging scenario in the troubled zone.

Department of Home has brought out a notification in this regard officials sources said.

While last year there were frequent strikes and State Police handled the Law and Order situation with all seriousness for which the area remained peaceful for quite some time.

Now it is apprehended that situation once again may deteriorate so the State Government has decided to enhance the ESMA period for another six months with effect from 16 May. 

ESMA is clamped in public interest as it is necessary to prohibit strikes in these areas as it is connected with production of coal and its transportation and dispatch to companies like NALCO, NTPC, TTPS and other power plants.

ESMA prohibits strikes in services connected with generation and supply of power in all establishments of National Thermal Power Corporation (NTPC) Kaniha Power Station and Talcher Thermal Power Station.

ESMA time period is extended for the purpose of keeping peaceful industrial environment and maintaining continuity in generation and supply of power in the State.

ESMA is clamped to prevent agitation, blockades, and strikes by the workers and transportation in the Talcher Coalfield Areas.

So with extension of ESMA the State Government hereby prohibit strikes in the aforesaid services for a period of six months with effect from 16 May, 2020, officials say.

In fact ESMA is considered to be the last resort a essential service provider use to bring normal operation of services, however it depends of the Law Enforcing Agencies to implement the orders.
